The following describes the terms on which Where’s Your World, Inc. offers you access to our services.

Welcome to Where’s Your World, Inc... By using the services on the Where’s Your World  websites/Worlds (WheresYourWorld.com and other websites/Worlds where this agreement appears) (the “Sites/Worlds” or “Worlds”), you are agreeing to the following terms, including those available by hyperlink, (the "Agreement" or "Member Agreement") with Where’s Your World Inc. and the general principles for the websites/Worlds of our subsidiaries, webchisees, business partners, and affiliates.

Before you may become a member of Where’s Your World, you must read and accept all of the terms and conditions in, and linked to, this Member Agreement and the Privacy Policy. We strongly recommend that, as you read this Member Agreement, you also access and read the linked information. By accepting this Member Agreement, you also agree that your use of all Where’s Your World-branded websites/Worlds or websites/Worlds we operate may be governed by separate member agreements and privacy policies. The agreement that applies on any of our domains and sub domains is always the agreement that appears in the footer of each website.

This initial Agreement is effective on January 1st, 2007, for current members, and upon acceptance for new members.

Where’s Your World, Inc., Where’s Your World, WheresYourWorld.com, Webchise, Webchising, Webchisor, Webchisee, Webchise Unit, Webchise Area, “It’s Your World, Live It”, and other Where’s Your World graphics, logos, page headers, button icons, scripts, and service names are trademarks, registered trademarks or trade dress of Where’s Your World, Inc. or its affiliates in the U.S. and/or other countries. Where’s Your World, Inc. trademarks and trade dress may not be used in connection with any product or service that is not Where’s Your World, Inc., in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits WheresYourWorld.com. All other trademarks not owned by Where’s Your World, Inc. or its affiliates that appear on our sites/worlds are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Where’s Your World, Inc. or its affiliates.

Using Where’s Your World                                                     [Back]

While using the Sites/Worlds or Worlds, you will not:

·        post inappropriate content or items on the Sites/Worlds or Worlds;

·        violate any laws, third party rights, or our policies;

·        use the Sites/Worlds or Worlds if you are not able to form legally binding contracts, are under the age of 18, or are temporarily or indefinitely suspended from our Sites/Worlds/Worlds; 

·        circumvent or manipulate our fee structure, the billing process, or fees owed to Where’s Your World;

·        post false, inaccurate, misleading, defamatory, or libelous content (including personal information);

·        take any action that may undermine the feedback or ratings systems on articles, pictures, events, blogs, or vlogs (such as displaying, importing or exporting feedback information off of the Sites/Worlds or for using it for purposes unrelated to Where’s Your World);

·        transfer your Where’s Your World account and Member ID to another party without our consent;

·        distribute or post spam, chain letters, or pyramid schemes;

·        distribute viruses or any other technologies that may harm Where’s Your World, or the interests or property of Where’s Your World members;

·        copy, modify, or distribute content from the Sites/Worlds and Where’s Your World's copyrights and trademarks; or

·        harvest or otherwise collect information about members, including email addresses, without their consent.

Abusing Where’s Your World                                                 [Back]

Where’s Your World and the Community work together to keep the Sites/Worlds working properly and the Community safe. Please report problems, offensive content, and policy violations to us immediately at webmaster@wheresyourworld.com .

Where’s Your World works to ensure that posted content does not infringe upon the copyright, trademark or other rights of third parties. If you believe that your rights have been violated, please contact our webmaster immediately at webmaster@wheresyourworld.com and we will investigate.

Without limiting other remedies, we may limit, suspend, or terminate our service and member accounts, prohibit access to our website, remove hosted content, and take technical and legal steps to keep members off the Sites/Worlds if we think that they are creating problems, possible legal liabilities, or acting inconsistently with our policies. We also reserve the right to cancel unconfirmed accounts.

Joining Where’s Your World and participating is free. We do charge fees for using other services, such as offline events hosted by Where’s Your World, Inc as well as other fee based services. When you use a service that has a fee you have an opportunity to review and accept the fees that you will be charged for, which we may change from time to time. We may choose to temporarily change the fees for our services for promotional events or new services, and such changes are effective when we post the temporary promotional event or new service on the Sites/Worlds.

Unless otherwise stated, all fees are quoted in U.S. Dollars. You are responsible for paying all fees and applicable taxes associated with the Sites/Worlds in a timely manner with a valid payment method. If your payment method fails we may collect fees owed using other collection mechanisms. (This includes charging other payment methods on file with us, retaining collection agencies and legal counsel, and for accounts over 180 days past due, and/or deducting the amount owed from your Papal account balance if you have one.)

When you give us content, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub licensable (through multiple tiers) right to exercise the copyright, publicity, and database rights (but no other rights) you have in the content, in any media known now or in the future. (We need these rights to host and display your content.)

You will not hold Where’s Your World responsible for other members' actions or inactions, including things they post.

We cannot guarantee continuous or secure access to our services, and operation of the Sites/Worlds may be interfered with by numerous factors outside of our control. Accordingly, to the extent legally permitted, we exclude all implied warranties, terms and conditions. We are not liable for any loss of money, goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of our Sites/Worlds. Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, so such disclaimers and exclusions may not apply to you.

Regardless of the previous paragraph, if we are found to be liable, our liability to you or to any third party is limited to the greater of (a) the total fees you paid to us in the 12 months prior to the action giving rise to the liability, and (b) $100.

If you have a dispute with one or more members, you release us (and our officers, directors, agents, subsidiaries, affiliates, joint ventures, webchisees, business partners, and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.

Access and Interference                                                           [Back]

The Sites/Worlds contain robot exclusion headers. Much of the information on the Sites/Worlds is updated on a real-time basis and is proprietary or is licensed to Where’s Your World by our affiliates, business partners, advertisers, members, or third parties. You agree that you will not use any robot, spider, scraper or other automated means to access the Sites/Worlds for any purpose without our express written permission.

Additionally, you agree that you will not:

·        take any action that imposes or may impose (in our sole discretion) an unreasonable or disproportionately large load on our infrastructure;

·        copy, reproduce, modify, create derivative works from, distribute, or publicly display any content (except for Your Information) from the Sites/Worlds without the prior expressed written permission of Where’s Your World, as applicable;

·        interfere or attempt to interfere with the proper working of the Sites/Worlds or any activities conducted on the Sites/Worlds; or

·        bypass our robot exclusion headers or other measures we may use to prevent or restrict access to the Sites/Worlds.

We do not sell or rent your personal information to third parties for their marketing purposes without your explicit consent. We use your information only as described in the Where’s Your World Privacy Policy. We view protection of members' privacy as a very important community principle. We store and process your information on computers located in the United States that are protected by physical as well as technological security devices. You can access and modify the information you provide us and choose not to receive certain communications by signing-in to your account. We use third parties to verify and certify our privacy principles. For a complete description of how we use and protect your personal information, see the Where’s Your World Privacy Policy. If you object to your Information being transferred or used in this way please do not use our services.

Indemnity                                                                                [Back]

You will indemnify and hold us (and our officers, directors, affiliates, business partners, webchisees agents, subsidiaries, joint ventures and employees), harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement, or your violation of any law or the rights of a third party.

No Agency                                                                               [Back]

No agency, partnership, joint venture, employee-employer or webchisor-webchisee relationship is intended or created by this Agreement.

Resolution of Disputes                                                             [Back]

If a dispute arises between you and Where’s Your World, our goal is to provide you with a neutral and cost effective means of resolving the dispute quickly. Accordingly, you and Where’s Your World agree that we will resolve any claim or controversy at law or equity that arises out of this Agreement or our services (a "Claim") in accordance with one of the subsections below or as we and you otherwise agree in writing. Before resorting to these alternatives, we strongly encourage you to first contact us directly to seek a resolution. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.

·        Law and Forum for Disputes - This Agreement shall be governed in all respects by the laws of the State of Florida as they apply to agreements entered into and to be performed entirely within Florida between Florida residents, without regard to conflict of law provisions. You agree that any claim or dispute you may have against Where’s Your World must be resolved by a court located in Osceola County Florida, except as otherwise agreed by the parties or as described in the Arbitration Option paragraph below. You agree to submit to the personal jurisdiction of the courts located within Osceola County, Florida for the purpose of litigating all such claims or disputes.

·        Arbitration Option - For any claim (excluding claims for injunctive or other equitable relief) where the total amount of the award sought is less than $10,000, the party requesting relief may elect to resolve the dispute in a cost effective manner through binding non-appearance-based arbitration. In the event a party elects arbitration, they shall initiate such arbitration through an established alternative dispute resolution ("ADR") provider mutually agreed upon by the parties. The ADR provider and the parties must comply with the following rules: a) the arbitration shall be conducted by telephone, online and/or be solely based on written submissions, the specific manner shall be chosen by the party initiating the arbitration; b) the arbitration shall not involve any personal appearance by the parties or witnesses unless otherwise mutually agreed by the parties; and c) any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.

·        Improperly Filed Claims - All claims you bring against Where’s Your World must be resolved in accordance with this Resolution of Disputes Section. All claims filed or brought contrary to the Resolution of Disputes Section shall be considered improperly filed. Should you file a claim contrary to the Resolution of Disputes Section, Where’s Your World may recover attorneys' fees and costs up to $1000, provided that Where’s Your World has notified you in writing of the improperly filed claim, and you have failed to promptly withdraw the claim.

Each of these policies may be changed from time to time. Changes take effect when we post them on the Sites/Worlds. When using particular services on the Sites/Worlds, you are subject to any posted policies or rules applicable to services you use through the Sites/Worlds, which may be posted from time to time. All such policies or rules are hereby incorporated into this Agreement.

Where’s Your World Inc. is located at 220 Red Maple Dr, Kissimmee, Florida 34743. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. In our sole discretion, we may assign this Agreement in accordance with the Notices Section. Headings are for reference purposes only and do not limit the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. We do not guarantee we will take action against all breaches of this Agreement.

We may amend this Agreement at any time by posting the amended terms on the Sites/Worlds. Except as stated elsewhere, all amended terms shall automatically be effective 30 days after they are initially posted on the Sites/Worlds. Additionally, we will notify you through the Sites/Worlds' as necessary. This Agreement may not be otherwise amended except in a writing signed by you and us. This Agreement sets forth the entire understanding and agreement between us with respect to the subject matter hereof. The following Sections survive any termination of this Agreement: Fees and Services (with respect to fees owed for our services), Release, Content License, Liability, Indemnity and Resolution of Disputes.

Community Content Policy             [Back]

Where’s Your World provides members a wide variety of specific recreational and hobby Blogs, such as, but not limited to, Reviews, Guides, Blog Entries, Wiki Articles, and Member-Created information, to enable our members to provide factual information, personal opinions about products, services, or events, and guidance on a variety of topics; and to publish other personal commentary and content on our site.

Community content published or edited by Where’s Your World Community members is solely the opinion and responsibility of the person posting the content. All content posted to one of these Blogs must comply with all aspects of the Where’s Your World Member Agreement and this policy.

See the Examples section below for examples of content that is not permitted. These examples are designed to provide guidance when self-publishing content on our site and should not be viewed as an exhaustive list.

Violations of Where’s Your World policies, including this policy, may result in a range of actions, including:

·        Content removal

·        Limits on account privileges

·        Loss of privilege to provide future content

·        Account suspension or revocation.

Blogs Usage & Photo

The Where’s Your World Blogs were created to provide a forum where members can connect with other members, receive support and information concerning specific interests and hobbies, and learn more about Where’s Your World and their collecting interests.. By following the principles found in the Where’s Your World Community Values, the entire Community will continue to find the Blogs a helpful, educational and enjoyable place to meet and converse. Courteous and respectful postings are expected from all participants.

Members can also submit a photograph to be uploaded on WheresYourWorld.com. By doing so you agree to the following terms and conditions for submission of your photograph:

We encourage all members to submit at least one photo so that members can easily recognize each other.

Any photo containing nudity, pornography, sexually explicit images or any copyrighted image (unless you own the copyright) is not permitted. Photos of celebrities and cartoon or comic images are generally copyrighted by the owner.

For security and privacy reasons, any photo that contains personally identifiable contact information such as phone number, email address or web site URL is not permitted. Uploading images of other people without their permission is also prohibited.

Submitted photos are automatically resized.

The Blogs Usage and Photo Submission Policy applies only to WheresYourWorld.com members. WheresYourWorld.com reserves the right to review all blogs and/or photos and to remove any blog or photo for any reason at our sole discretion. If you see a blog or photo on WheresYourWorld.com that you believe does not conform to this policy, please email us immediately at webmaster@wheresyourworld.com .

Members wishing to post blogs and/or photos on any of our Sites/Worlds must adhere to these policies. Violations of this policy may result in a range of actions, including:

·        Content and/or photo removal

·        Limits on account privileges

·        Loss of privilege to provide future content and/or photos

·        Account suspension or revocation.

What is “Webchising”? Webchising is a business opportunity for individuals, groups, or businesses who are subject matter experts targeted to a specific category “World” hobby or interest. A subject matter expert interested in turning their interest or hobby into a business opportunity may apply for a “Webchise” to Where’s Your World, Inc. The specific category “World” applied for is subject to the “World” availability. “World” availability is not necessarily dependent upon whether or not the “World” is in use within the WheresYourWorld.com community, as Where’s Your World, Inc. operates and facilitates certain “worlds” that might also be available for potential Webchisee’s. Applicants who are interested in Webchising must be able to provide members in a specific category “World” with useful online/offline community resources in order to bring people together and enrich their lives with common interests.
